Ag Resource Management, LLC and its affiliates and subsidiaries, which include Ag Resource Holdings, LLC, Ag Resource Servicing, LLC, Ag Resource Insurance, LLC, and Agrifund, LLC (collectively, “ARM,” “our,” “we,” or “us”) may use text messages to inform customers about their credit application, loan-related information and servicing, or crop insurance policies. These messages are intended solely for the recipient, are confidential between ARM and the recipient and are not a promise to extend credit or a requirement for any application for extension of credit.  

CONSENT TO CONTACT

Your use of the Text (SMS) Message Service (“Text Service”) constitutes your acceptance of and agreement to be bound by these Terms and Conditions. As a condition of using the Text Service, you represent and warrant that you will provide a valid mobile telephone number and you expressly consent to the receipt of text messages transmitted by us through your designated wireless carrier. 

  1. You have provided us with your consent to send you text messages in conjunction with the products, two factor authentication, and financial services we are providing you. We may send any text message through your communication service provider in order to deliver it to you. You agree that your communication service provider is acting as your agent in this capacity. 
  2. You agree to provide a valid phone number for this Text Service so that we may send you certain information about your applicable account. We determine in our sole discretion, what information we make available through this Text Service. If you change your mobile phone number or surrender ownership of the number you provided to ARM, you agree to immediately notify ARM of that change by emailing our Support Team at service@armlend.com. 
  3. Use of the Text Service does not amend, modify, or create any rights or obligations beyond those set forth in any loan documents or crop insurance policies. All such documents and policies shall govern in the event of any conflict with information provided through the Text Service. Text communications are provided solely for informational purposes and shall not be construed as legal, financial, or contractual advice, nor as notice of any kind required under your loan documents or crop insurance policies. 
  4. The Text Service may not be encrypted and may include personal or confidential information about you, such as your account activity or status. You agree to protect your communications device that receives information through the Text Service and not to let any unauthorized person have access to the information we provide to you through the Text Service. 
  5. ARM will not share your mobile information with third parties for marketing or promotional purposes. 
  6. The delivery of loan or crop insurance information through the Text Service may be subject to delay, interruption, or other impact due to circumstances involving your wireless carrier or third-party service providers. ARM makes no warranty regarding availability or reliability of the Text Service, and shall have no liability related to any delay or failure in the delivery or receipt of text messages. 
  7. ARM does not charge a separate fee for the Text Service; however, you are responsible for fees associated with text messaging imposed by your wireless service provider. Standard message charges may apply. Message frequency depends on user preferences.  
  8. ARM may change these Terms and Conditions at any time, without notice, except as required by law. Such updated Terms and Conditions shall be effective when posted on our website. Your continued use of the Text Service after the Terms and Conditions have changed shall constitute your acceptance of the new Terms and Conditions.  

TWO-FACTOR AUTHENTICATION (2FA) 

We may use SMS text messaging to provide two-factor authentication (2FA) or other security-related communications to help protect access to your loan account(s). These messages may include verification codes or other account security prompts. You may not be able to opt out of receiving SMS messages that are necessary for authentication or security purposes. Message and data rates may apply. 

REMOVAL/OPTING OUT FROM TEXT MESSAGING

If you no longer wish to receive messages through the Text Service, you may opt out at any time by sending the command STOP to the number that you received from ARM, or by contacting our Support Team at 1 (888) 706-4447 or by emailing service@armlend.com. All requests to opt out will be honored within a commercially reasonable amount of time. 

AVAILABLE TEXT COMMANDS

While individual text messages from ARM may contain specific command instructions, the following commands may be used at any time to interact with the Text Service: 

  • STOP: By texting STOP to the number that you received from ARM, your number will be removed from text messaging notifications and campaigns. 
  • START: By texting START to the number that you received from ARM, you can re-enroll in messages. 
  • HELP: By texting HELP to the number that you received from ARM, you will be able to access information and help. 

INDEMNIFICATION

You agree to indemnify, defend, and hold us harmless from and against any and all claims, losses, liability, costs, and expenses (including reasonable attorneys’ fees) arising from your provision of a phone number that is not your own or your violation of applicable federal, state, or local law, regulation or ordinance. Your obligation under this paragraph shall survive termination of these Terms and Conditions.  

REPORT ABUSE

Text messages to ARM phone numbers are not encrypted. Do not send sensitive or nonpublic personal information to ARM in a text message. If you receive a text message purported to be from ARM that requests you send a text with sensitive or non-public personal information, please do not respond to it. Instead, contact our Support Team at 1 (888) 706-4447. 

LANGUAGE

ARM’s products and services are offered in English. Any translations of text messages into other languages are intended solely as a courtesy, and not an indication that an application for credit or a loan transaction may occur in that language. If there is any discrepancy between the content of a text message communication from ARM in a language other than English, the English version will control.
